Federal Judge Throws Out Britney Case

Ok so there's a whole lotta new drama surrounding the Britney Spears case going to federal court so try to keep up...I'll try to make it short and sweet. It's so obvious that Sam Lutfi has teamed up with attorney Jon Eardley (the NYC based lawyer that filed paperwork last week) to get the case up to Federal Court. Eardley claims that Britney's civil rights are being violated and she supposedly hired him to take over the case. Yesterday Britney's real lawyers filed paperwork asking the judge to ignore Eardley's request to move her case out of the California Court system. "In the papers, the lawyers claim Britney was in no position to even hire a lawyer for the federal case because she's not allowed to under the conservatorship order," reports TMZ. The judge is not only pissed about the paperwork, he also rejected the case calling it "ridiculous" and is now asking Eardley to show proof that Britney hired him--as well as pay for new attorney fees. Judge Philip Gutierrez set a deadline of February 29 for Britney's so-called lawyer, Jon Eardley, to explain why the Federal court has any business getting involved in Britney's mental affairs.

Britney is Forever 21

Britney loves to shop! Our favorite popstar spent an afternoon shopping at clothing chain 'Forever 21' in Beverly Hills. At first she went to PF Chang's restaurant at the Beverly Center but decided not to wait for a table but instead go shopping for some new tops. That's our girl!

Britney's Dad Fights Back to Keep Control

Lawyers for Jamie Spears contend that Britney Spears's conservator case shouldn't be transferred from state to federal court and that an attorney seeking the move doesn't even represent the pop singer as he claims. In court papers filed Tuesday, Spears's father and the other temporary co-conservator of her estate, Andrew Wallet, called lawyer Jon Eardley's highly publicized efforts to move the case "a brazen – but vain – attempt to strip a probate court of jurisdiction ... by an attorney without a client."Eardley's effort got a cool reception from U.S. District Judge Philip Gutierrez, who on Tuesday gave Eardley until Feb. 29 to argue why Gutierrez shouldn't reject the request. If Eardley fails to make a good enough case by then, the matter stays in state Superior Court – with Jamie and Wallet remaining in charge of Britney's affairs and $100 million estate. "The jurisdictional allegations appear to be defective," said the the judge in a tentative ruling.
Legal Analyst Calls Challenge NovelEardley's approach "is certainly novel, but I don't think it can succeed," says Duke law school professor Erwin Chemerinsky, a constitutional law expert. "A case can be removed from state to federal court only if it could have been brought in federal court in the first instance. I can imagine no possible way that this case could have been brought in federal court in the first instance." Loyola Law School Professor Stan Goldman adds: "Wishing doesn't make it so." Eardley was unavailable for comment. His spokesperson, Michael Sands, said on Wednesday that Eardley would file "overwhelming evidence" as to why the case belongs in federal court. "Obviously the judge wants to see what we have expressed in our original papers," Sands says, adding he sees Gutierrez's request for additional documentation as a "great opportunity."
Lawyer Claims Britney's Civil Rights DeniedEardley has told PEOPLE that Britney – whose affairs have been overseen by the co-conservators since her hospitalization in a psych ward – is being "deprived of her Constitutional rights." He says he's seeking a "return to normalcy" when it comes to the singer's living and legal situations. But according to the co-conservator papers, a court has already found that Britney "lacks the capacity" to hire an attorney – Eardley or anybody else – and even if she did have that capacity, there are no legal grounds to move her case to federal court. The papers didn't say whom Jamie thought was behind Eardley's involvement, but noted that Eardley's spokesperson also represents Britney pal Sam Lutfi, now the target of a restraining order by the star's parents. Eardley, the papers allege, tried to do something similar in 2006 – allegedly seek to move a state case to federal court on behalf of a client he didn't have – and was ordered to pay the other side's attorney fees. "Given his prior experience, Mr. Eardley should have been especially attuned to the impropriety," the papers say.

Judge Puts Brakes on Britney License Trial

The continuing misadventures of Britney Spears have been, well, continued.
A Los Angeles judge has postponed the pop star's long-pending misdemeanor driving-without-a-license case until next month after her attorney cast doubt on the singer's ability to fully understand or enter into a settlement in the case.
Although Los Angeles Superior Court Judge T.K. Herman told both legal parties during a hearing last month that day's delay would be the trial's last, he continued this morning's proceedings at the behest of Spears' counsel.
Attorney J. Michael Flanagan told Herman during court this morning that Spears' conservatorship—i.e., father Jamie and lawyer Andrew Wallet—who have been placed in charge of both the 26-year-old's estate and her legal decisions, "do not think she is qualified or capable of entering into a binding agreement" at this time.
Furthermore, Flanagan told the court, they do not believe Spears is in any state to give a declaration or sign a deposition in the case.
Spears herself was neither in nor required to be at court this morning, because the driving-without-a-license count is only a misdemeanor.
The case itself stems from a fender-bending hit-and-run that transpired in full view of the paparazzi in a Studio City parking lot Aug. 6, 2007.
While a hit-and-run charge was subsequently dropped after Spears reached a settlement with the driver of the banged-up parked car, the ex-Mouseketeer was not in possession of a California state driver's license at the time of the ding.
She was, however, in possession of a valid Louisiana state license, a sticking point that has until now held up proceedings.
Last month, Flanagan and prosecutor Michael Amerian told the judge they needed more time to come to a consensus on which law, exactly, Spears had violated. At the time, Herman ordered both sides to come to an agreement or he would force the case to go before a jury.
Both sides are now due back in court Mar. 20.

Dad Fights "Brazen" Attempt to Move Brit Case

Despite some adamant claims to the contrary, Britney Spears' troubles are still very much an L.A. story.
A U.S. District Court judge has given attorney Jon Eardley—the latest legal eagle enlisted by the "Toxic" songstress to battle her father's conservatorship status—until Feb. 29 to provide a legitimate reason to remove the case from Los Angeles to federal court. (View the order.)
A hearing on the matter has been scheduled for Mar. 17.
Sam Lutfi's publicist filed a petition on Feb. 14 to transfer the case on behalf of the New York-based Eardley. The complaint alleged Britney's civil rights had been trampled by the court's refusal to properly investigate her family's claims that she's unfit to manage her finances, choose what company to keep and make various other decisions regarding her welfare.
Michael Sands, acting as spokesman for both Lutfi and Eardley, said last week that he had filed the documents before a court commissioner extended Jamie Spears' temporary conservatorship until Mar. 10, thereby making the action null and void.
Meanwhile, an L.A. Superior Court spokesperson said Friday that all Britney business remained under their jurisdiction.
"Jon Eardley is very happy that the judge will look at the explosive documentary evidence in the Britney Spears conservatorship railroad," Sands told E! News Tuesday.
"This is a very positive step that the judge is concerned. Jon Eardley will have court papers filed by Feb. 29...This is the first step in the victimization of Britney Spears by L.A. Superior Court."
But just in case Eardley can come up with an argument to sway U.S. District Judge Philip Gutierrez, Britney's father has cooked up plenty of reasons to block the switcheroo.
Jamie Spears' camp—arguing that Britney isn't capable of hiring counsel and, therefore, Eardley is "an attorney without a client"—filed a motion Tuesday objecting to Lutfi & Co.'s "brazen—but vain—attempt to strip a probate court of jurisdiction before it could enter Orders" prolonging the conservatorship. (View the motion.)
Eardley's "well-pleaded allegations" do not present an issue of federal law, the filing states, adding that any charges on Eardley's part that Jamie Spears "supplements" his daughter's medication "disregards the fact that the Probate Court has not granted Mr. Spears medical powers and that medications therefore do not fall within the scope of the conservatorship."
In response to Eardley's contention that Britney's "unenviable status of having virtually no privacy in her life" and her "suffocating confinement" at the hands of her conservators could affect the effectiveness of her treatment, the conservators argue, once again, that the probate court did not grant Jamie authority over the troubled pop star's medication.
"Because there is no logical relationship between Britney's fame and the alleged federal interest to be addressed," Eardley's concerns about Britney's medical treatment under her father's care are a moot point.
The conservators are also asking that Eardley foot the bill for this latest round of attorneys' fees, because he "lacked any reasonably objective basis" for filing the removal request.
But it's the fact that Britney was previously ruled incapable of hiring her own lawyers that will likely prove the largest obstacle to sending the case to federal court.
"In Britney's case, the commissioner revoked her power to retain her own legal counsel," Kevin Whittaker, a San Francisco-based litigation attorney who's not involved in the Spears case, told E! News last week. "Oftentimes, the conservatee can retain their own legal counsel. This wasn't the case with Britney. So, the new attorney's claim to be her legal counsel will be found invalid."
A reason why Jamie's camp is arguing that papers filed on her behalf listing Eardley as counsel of record don't amount to a hill of beans.
Jamie and attorney Andrew Wallet were named temporary conservators of Britney's multimillion-dollar estate on Feb. 1, the day after she was admitted to UCLA Medical Center's psych ward for evaluation.
Although Britney was spotted dining out with her dad in Hollywood over the weekend, sources close to her have said she is anxious to extract herself from his legal grip.
She has not met with Eardley in person, Sands said, but they have spoken several times. And sources close to the situation have said Britney has been in contact with Lutfi—through an intermediary.
Lutfi, who has continued to avoid being served with the Spears family's restraining order against him, "is at war with Jamie," a Spears insider told E! News Friday. "This is his first strike."

LAPD: We're Not After Sam Lutfi

Reports that Sam Lutfi is being investigated by the Los Angeles Police Department for allegedly drugging Britney Spears appear to be false. We spoke with LAPD Media Relations representative Richard French, who told us "there is no investigation into Sam allegedly medicating Britney." Follow-up calls to the LAPD Media Relations department were answered by Officer Lee, who said, "Who would you believe? The LAPD or Internet reports?"
Michael Sands, Sam Lutfi’s spokesman, exclusively tells us that “Internet tabloid gossip Web sites need to stop reporting bogus stories without knowing the truth. They need to stop brainwashing the public.”

Britney's Case Isn't Going to the Feds Yet

The motion to have Britney Spears' conservatorship hearing moved to federal courts appears to be going nowhere fast.
In court documents obtained by PageSix.com, Judge Gutierrez issued a ruling this afternoon stating that Jon Eardley, the lawyer who filed the motion, must make his case by February 29.
The burden of proof will be high, as current conservatorship judge Reva Goetz has previously ruled that Brit isn’t fit to retain counsel. Furthermore, Jamie Spears' attorneys state in a sworn declaration that Brit's father has already "incurred total attorneys' fees of more than $27,495 as a result of this remand.” Lawyers for Jamie are requesting to be compensated by Eardley.
While a Spears family insider lauds the decision — telling PageSix.com, "It's nice to see a little sanity reintroduced into all of this” — Eardley's spokesperson Michael Sands is less than impressed. Sands, who is also connected with Sam Lutfi, tells us, “Jamie Spears needs to stop violating Britney's civil rights granted to her under the Constitution. Maybe Jamie didn’t realize that Britney is being kept a prisoner in her own home. Jamie needs to be a stand-up guy and remove himself and his people from her residence until Judge Gutierrez makes his ruling."
For his part, Eardley says, “Judge Gutierrez is one of the most ethical federal judges and is highly respected.”

Lutfi Drug Probe -- Full Steam Ahead

Law enforcement sources tell TMZ the LAPD investigation into Sam Lutfi allegedly drugging Britney Spears is well underway. We're told the case has now been assigned to Robbery Homicide, primarily because of the sensitive nature of the allegations and the intense media interest in Britney Spears. Sources say investigators have interviewed several witnesses regarding the drugs in Brit's system at the time she was most recently committed. We're told the investigation had been temporarily derailed because of the death of an LAPD SWAT officer, but it's now back on track. One source says the investigation will probably be concluded in late March.

Federal Judge Says It Seems Bogus To Him

A Federal judge in the Britney conservatorship case has issued a tentative ruling that the move to make a federal case out of it is ridiculous.Judge Philip Gutierrez set a deadline of February 29 for Britney's so-called lawyer, Jon Eardley, to explain why on Earth the federal court has any business getting involved in Britney's mental affairs. The court said it sure seems the Feds have no jurisdiction to interfere, and unless Eardley can convince the judge to the contrary, the case will go back to State court on Feb 29.

Brit's Conservators Smell Lutfi!

Lawyers for Britney Spears' conservatorship filed papers yesterday in federal court, asking the court to reject the bid to remove the case from the California Court system. In the papers, the lawyers claim Britney was in no position to even hire a lawyer for the federal case because she's not allowed to under the conservatorship order. Attorney Jon Eardley, who filed the federal case, claims Britney hired him.Lawyers for the conservator also want Eardley to identify everyone with whom he worked to get the federal case filed. It's real clear the conservators believe Sam Lutfi who is behind it, hand he's been restrained from having any contact with Brit. The conservators' lawyers also want Eardley to pay attorney's fees, claiming the federal file is kinda frivolous.

K-Fed: Britney Needs to See the Kids!

K-Fed must be tired of being a full time daddy because he's really fighting for his ex wifey Britney Spears to get visitation. Yesterday both camps were back in court but the judge didn't make any changes to the custody battle. After the hearing, Federline's attorney Mark Vincent Kaplan insisted his client wants to see the situation resolved as the children need their mother. He says, "Both sides want to see the day that visitation can resume. It is a question of working out details on how that can happen. Mr. Federline looks forward to his children having their mum in their life." Kaplan adds Federline "is doing everything that he can to make up for the fact that the boys are with him and keeping family around and trying to have them not aware that there's any change whatsoever. He's doing great at being a parent."

Another Day, Another Hearing for Britney

There was another hearing today in L.A. in the case related to Britney Spears August hit-and-run accident. Britney's lawyer, Michael Flanagan, asked Judge T.K. Herman for a continuance because the pop star is under a conservatorship and "isn't qualified at this time to enter into a legally binding matter."
The judge granted a continuance until March 20 and said it would be the last continuance, but added that he realized the 26-year-old needed to be judged legally competent before the case could proceed. The hit and run charges against Britney were previously dismissed, but she still faces a charge of driving without a license.

Brit's Family and K-Fed Want Her to See Her Sons

Britney Spears isn't just spending her days shopping: She's calling ex Kevin Federline.
A source close to the Spears family tells PageSix.com that the 26-year-old singer has been in touch with K-Fed in the hopes of making an arrangement to see their sons. And despite yesterday's court ruling, both Kevin and her family are willing to work to make it happen.
"Besides getting her the ongoing medical care she needs, [dad] Jamie's sole focus is for her to regain some visitation rights to see her boys, Sean Preston and Jayden James," another source tells us.
The goal once again makes the Spears family and Kevin unlikely allies. While Kevin makes sure to talk about Britney with the boys whenever he can, Britney's family has been working so hard to find a solution for her troubles, they've brought in backup, via brother Bryan.
Despite being on Brit's side, our source says Kevin's not ready to give up primary custody: "Kevin has gotten so close to the boys that he can't hardly fathom them being put back into Britney's care. He fears for them and their future, but also fears for Britney if she does not get control and start seeing them again."
A source tells us that should Jamie Spears succeed and convince Commissioner Scott Gordon to grant visitation, safeguards would be put in place, including Papa Spears being present while Brit spends time with her sons.
The common cause will only be aided by new attorney Stacy Phillips, a Spears family insider explains. "Stacy will not exploit this sensitive situation for attention, and like the other conservatorship lawyers already in place, will take the high road and act with integrity."

TMZ Photogs Busted in Britney Sweep

The cops have cracked down bigtime on paparazzi -- no, not the ones who blow red lights. Not the ones who run cars off the road. Not the ones who threaten to kill people who get in their way. The L.A. County Sheriff's Department is going after ... sidewalk violators!!!By our count, six camerapeople were busted last night; two outside the salon where Brit was getting her hair done and four outside Villa nightclub where Lindsay was partying. Two TMZ photogs were among those busted. One deputy is heard warning paps, "You're slowing down, you're stopping on my sidewalk." When asked what law the photogs were violating, a deputy cited West Hollywood Municipal Code, Section 3.04.030, the Traffic Safety Fund. That section funnels traffic violation money to bankroll traffic lights and other stuff. One TMZ photog says he had just stepped off the sidewalk when he was cuffed and thrown into the back of a squad car for an hour. Another TMZ photog was hauled off to jail for 6 hours.

Britney Suffering From Memory Loss?

Could Britney Spears be suffering from memory loss? This past weekend Spears and her dad Jamie hit up The Social restaurant in Hollywood for some late night grub. Sources tell Hollyscoop EXCLUSIVELY that Britney seemed a little dazed and confused while at the restaurant. She hardly touched her food and she went to the bathroom "every 15 minutes." She spent most of the night chain-smoking near the bar. Our spies overheard Spears asking the general manager of the restaurant "how long they had been open" and "what was upstairs." She complimented the manager on the restaurant and told him she thought it was beautiful inside. The manager, who was clearly confused by her comments, politely replied, "Thank You." The Social is the same place Britney shot her music video "Piece of Me" back in November of '07. Spears was more than 12 hours late to the shoot but was eventually driven there by douchbag Sam Lutfi. She arrived in her pajamas at 8:35PM and stayed until 6:30AM. Sadly Britney has no recollection of ever being at the venue. She spent more than 9 hours 'upstairs' shooting her music video but doesn't recall ever being there. Obviously all the drugs that Lutfi admitted giving Spears took a toll on her memory. I wonder if she even recalls half the things she's done while under Lutfi's control?

Lawyer: Dad Helping Britney's Bid for Visitation

What will it take for Britney Spears to regain visitation rights with her two sons? That remains to be seen. But the pop star's tentative reconciliation with her father, Jamie, is a step in the right direction, says Kevin Federline's lawyer. In fact, attorney Mark Vincent Kaplan was full of praise for the elder Spears, who has emerged as a controversial force in Britney's life recently – and who was front-and-center at Tuesday's family court hearing. "Jamie Spears's presence is an extreme positive," Kaplan told PEOPLE, adding that the patriarch's continued presence could make it possible "to develop a visitation plan that enables these children to have a mother in their lives." While Britney's visitation with children Preston, 2, and Jayden, 1, was discussed at Tuesday's hearing, there was no official legal progress on the matter. (Spears has not seen her sons since her Jan. 3 standoff with police.) Still, Kaplan said, "[Jamie] brings that day closer. Absolutely." Jamie's role as temporary co-conservator – overseeing Britney's wellbeing and estimated $100-million fortune – has attracted its share of criticism. His own daughter is apparently seeking legal remedies to regain control and, in a recent interview with PEOPLE, attorney Jon Eardley claimed that Jamie's conservatorship was a "violation of [the singer's] civil rights." Kaplan, however, sees Jamie's control as a "huge step." "He's building from the ground up," the attorney explained. "[He's] stabilizing the situation, removing people that may not have had [Britney's] best interests at heart." Does that mean Britney could see her kids again in the near future? "We all want this as soon as possible," said Kaplan. "That's Kevin's desire – to have his kids visiting their mother. That's everyone's goal in this case."

It's Like 'Groundhog Day'

No, you aren't reading a post from the weekend, or last month, or last year. This is, in fact, Britney Spears, stepping out of a car and once again flashing the world her lady business last night. Ironically, the pop star was headed into B2V Salon when she flashed her bare necessities. The style-free songstress, 26, was getting her extensions tended to, much like a farmer doing crop rotation, at the salon co-owned by her longtime colorist, Kim Vo.

Brit Keeps Toys Ready for the Boys

Even though Britney Spears was just denied in her bid to get some form of visitation with her sons, as TMZ reported yesterday, she's still hanging on to hope, no matter how slender it might be."[Brit] hasn't put the children's belongings away," says "an insider" to Us. "She desperately wants the kids. She cries about it." Apparently, K-Fed and even Brit's parents won't let the momwreck talk to the kids on the phone. As for J.J. and Sean, it seems that the K-Daddy, their grandparents, and nanny don't talk to them about Mama Brit. "They don't want to get them riled up. They just keep them focused on activities."

Britney Has Had ZERO Contact With Her Kids

Despite rumors that they have been speaking, Britney Spears has not been in touch with her boys since January 3rd. Sadly.
Kevin Federline and Spears' parents won't let Britney speak on the phone to her sons, Us Weekly is reporting.
However, that will hopefully change soon.
K-Fed's lawyer has nothing but praise for Britney's dad, who is acting as her conservator.
"Jamie Spears's presence is an extreme positive," Mark Vincent Kaplan tells People. "He's building from the ground up. [He's] stabilizing the situation, removing people that may not have had [Britney's] best interests at heart."

Such A Small World

Those pesky paparazzi!
Photogs snapped Britney Spears through the shades as she had a day of beauty on Tuesday.
The recovering pop star was getting her hair did at our salon of all places.
Maybe we'll run into her next time we're there!

Britney Spears Gets a New Attorney – Again

Once again, Britney Spears has a new lawyer: High-profile attorney Stacy D. Phillips became the latest to sign on for the custody case. Phillips, who was approved by a court commissioner Tuesday, replaced Sorrell Trope, who quit after complaining of problems communicating with the troubled pop star.A Columbia University law grad, Phillips represented Bobby Brown in his divorce from Whitney Houston, and Tori Spellling's ex, Charlie Shahnaian. She's also a frequent legal analyst in magazines and on television. She also authored Divorce: It's All About Control, once explaining that, "I've yet to handle a divorce where control was not an issue or at issue." Phillips becomes Spears's fourth lawyer in her ongoing battle with ex-husband Kevin Federline. Her first attorney, Laura Wasser, resigned from her case last September shortly after Spears's divorce from Federline was finalized. Spears then hired the firm Freid & Goldsman, but their relationship ended within days, before retaining Trope, who sought to leave the case, come back, then filed papers again to depart, this time for good.
