Lawyer Jon Eardley who claims he represents Ms Spears has contested a court ruling that allow her father James to control of her assets and estate until July.
Jon Eardley, has filed the appeal with the Los Angeles Superior Court, claiming the singer was not given the required notice as stated by law, when the "conservatorship" was granted, Conservatorship is granted in cases where a person cannot look after their own affairs.
Eardley claims the "five-day notice requirement" was been dispensed without "legitimate grounds", according to the papers presented to the court.
In February a California state court granted a temporary conservatorship order to Britney Spears father James along with lawyer Andrew Wallet.
In previous court filings by telephone Mr Eardley claimed he was employed by Ms Spears , though the federal judge hearing the case said Eardley could not work for the singer because at the time Eardleys claims he was hired, Ms Spears did not have the authority to take him on.
The court stated Mr Spears and Mr Wallet were the only two people who had the authority to employ lawyers on her behalf.
Despite the singer's personal crisis, a third single from her 2007 album, Blackout, is to be released.
